Partition Action Trial Involving 4,500 Acres of Agricultural Lands.

Burgess & Bogener, Inc. recently tried a partition action case in the County of Butte involving a 4,500 acre ranch impacted by differing land use zones, the Williamson Act, and various planning complications. After several days into trial, a successful settlement was reached on behalf of their clients that allowed preservation of the clients’ family ranch house, its water source, and its surrounding acreage abutting adjacent holdings occupied by their clients.

Public Employee Termination Upheld.

Burgess & Bogener, Inc. successfully defended Fire Protection District in lengthy arbitration to uphold the termination of a District firefighter.

Recently the firm successfully handled the matter of Jurich v. Desert Outdoor Advertising, Inc., which dealt with contract litigation with an emphasis on outdoor advertising under the province of the City of Alameda’s Municipal Code. In an interesting case of corporate deceit and alleged wrongful conduct, the result properly focused on the doctrine of equitable tolling and the intricate differences of indemnity law. The former being a doctrine founded in case law and the latter in statute; both were instrumental in the trial’s outcome. Congratulations to our client, Paul R. Jurich.
